Embryos can be claimed as dependents on Georgia state tax returns

On the heels of the Supreme Court’s overturning of Roe v. Wade, Georgia has introduced a new policy allowing embryos to be claimed as dependents on state tax forms.

The policy went into effect on July 20 of this year and states that any “unborn child with a detectable human heartbeat” may qualify for a $3,000 state income tax deduction for 2022. This means future parents may claim embryos as dependents if they are six weeks into the pregnancy on or after July 20.

The guidance also states that relevant supporting documentation must be provided if requested by the Department of Revenue.
